Pay
for Work Performed at Home

If an employee is unable to complete assigned work
during the day and decides to take it home to finish, is
the employer required to pay the employee for the time
spent working at home? The answer is an emphatic “yes.”
The Department of Labor states, “In all such cases it
is the duty of the management to exercise its control
and see that the work is not performed if it does not
want it to be performed. It cannot sit back and accept
the benefits without compensating for them. The mere
promulgation of a rule against such work is not enough.
Management has the power to enforce the rule and must
make every effort to do so.” This rule applies whether
an employee performs work at the workplace or at home.
If the employer is getting the benefit of the employee’s
efforts, it must pay for them. Of course, overtime must
be paid for any hours over 40 worked in a week.
The employer is liable if it knew or should have
known the work was being performed and suffered or
permitted the work to be done. The employer is not
liable for failing to pay for the work only if, despite
reasonable inquiries, it did not know the work was being
performed. In order to make sure employees are not
working without employer knowledge, employers need to
keep good records and inform employees that all work
time needs to be approved.
Taking unfinished work home cannot be a pay issue,
but may be a performance issue. If work is not correctly
completed during the workday, it is the supervisor’s
responsibility to work with the employee to determine
why the work is not being completed. It may be a problem
of ability, motivation, or workload. A coaching session
with feedback and follow-up may help to determine the
cause, generate solutions, and either get the employee
on track or determine that the employee cannot do the
job.
